1. Acceptance of Terms
By accessing this website, booking a cleaning service, or submitting any information through our online forms, you agree to be bound by these Terms & Conditions, our Privacy Policy, and all applicable laws and regulations.
If you do not agree to these terms, you are prohibited from using or accessing this site.
These Terms apply to both residential and commercial services unless a separate written agreement is executed for commercial services, in which case the written agreement controls to the extent of any conflict.
2. Services Provided
Tampa Bay Shine provides residential and commercial cleaning services throughout the Tampa Bay area. All service descriptions, pricing, service checklists, and promotional details listed on this website are subject to change at any time.
We reserve the right to refuse, pause, modify, or stop service to any individual or property for safety, suitability, policy-related reasons, or where conditions materially differ from what was booked.
We do not provide specialty remediation services such as mold remediation, pest control, biohazard cleanup, hoarding cleanup, or hazardous material removal unless explicitly agreed in writing.
3. Website Use & Intellectual Property
All content on this website—including text, images, graphics, branding, logos, service descriptions, PDFs, and downloadable materials—is the property of Tampa Bay Shine and is protected under U.S. copyright, trademark, and intellectual property laws.
You may not:
- Copy, modify, or reproduce website materials
- Republish or distribute any content without permission
- Attempt to reverse-engineer or tamper with website functionality
- Use our content for commercial purposes without written authorization
Limited permission is granted to temporarily view materials for personal use only.
4. Booking, Pricing & Payment Terms
4.1 Online Booking & Property Details
All bookings made through our website or scheduling system are considered requests and will be confirmed by our team. You agree to provide accurate details about the property and requested scope. Tampa Bay Shine reserves the right to modify the booking, adjust the estimated duration, and/or update pricing based on property condition, access constraints, or scope changes.
4.2 Scope of Each Clean (Checklist Controls)
Each service level (e.g., Standard, Deep, Move-In/Move-Out, etc.) has a defined scope. Our checklist describes what is included in each level. The checklist is available at https://tampabayshine.com/checklist and may be updated from time to time.
- We clean within the scope of the service level selected at booking.
- Any areas/items not included in the selected service level are excluded unless added as a paid extra or approved scope upgrade.
- Results can vary based on material condition, age of surfaces, prior buildup, hard water, etching, grout condition, stains, and normal wear and tear.
4.3 On-Site Requests, Additional Services & Upcharges
Additional services requested on-site (or after booking) may require additional time and will incur an upcharge. If you request add-ons or scope changes, you authorize Tampa Bay Shine to adjust the service total accordingly once we confirm the add-on pricing with you (in writing, text, or within the booking system).
If additional requests would prevent timely completion of the booked scope, we may prioritize the original scope, reschedule the added items, or upgrade the service level with your approval.
4.3.1 Add-On Preparation Requirements
Certain add-ons require customer preparation so we can safely and efficiently clean the interior surfaces.
- Inside Cabinets add-on: Cabinets must be fully emptied prior to service.
- Inside Fridge add-on: Refrigerator must be fully emptied prior to service.
- We do not remove food, dishes, trash, or personal items unless an organizing/removal service is added and paid for.
- If not emptied, we may skip, reduce scope, reschedule, and/or charge an additional organizing/removal fee.
4.4 Move-Out / Turnover Cleaning Readiness Requirement
Move-out / turnover cleans require the space to be reasonably cleared of personal items and debris before our arrival, including (without limitation): furniture, dishes, food, trash, clothing, boxes, and general belongings.
- If the property is not cleared, we reserve the right to (a) reschedule, (b) reduce scope to what can be safely cleaned, and/or (c) charge an additional fee for organizing, bagging, moving items, or otherwise preparing the space for cleaning.
- Any organizing, item removal, bagging, or disposal assistance is not included in the standard move-out scope unless explicitly added and paid for.
- For safety and efficiency, we do not remove large/heavy furniture, appliances, or construction debris unless explicitly agreed in writing.
4.4.1 Inside Cabinets & Inside Fridge in Move-Out Cleaning
Move-Out Cleaning typically includes inside cabinets and inside the refrigerator. Even when included, cabinets and the refrigerator must be fully emptied prior to service.
- Inside Cabinets (included in Move-Out): Cabinets must be fully emptied prior to service.
- Inside Fridge (included in Move-Out): Refrigerator must be fully emptied prior to service.
- We do not remove food, dishes, trash, or personal items unless an organizing/removal service is added and paid for.
- If not emptied, we may skip, reduce scope, reschedule, and/or charge an additional organizing/removal fee.
4.5 Customer-Selected Home Size (Sq Ft), Bedrooms & Bathrooms
During booking, you select the total size of the home (square footage), as well as the number of bedrooms and bathrooms. The square footage should reflect the total home square footage (not just a portion of the home).
- If the home size, bedroom/bath count, or overall scope is materially misrepresented, we reserve the right to modify the booking before service and/or apply a surcharge/upcharge to reflect the correct tier and time required.
- We may request verification (e.g., public property record square footage or a reasonable measurement confirmation) where details appear inconsistent.
- If the discrepancy is significant and impacts scheduling, we may reschedule or decline service.
4.6 Pricing Adjustments (Condition, Clutter, Special Conditions)
Prices shown online are estimates based on average home conditions. Additional fees may apply for:
- Excessive dirt, buildup, or unusually heavy detail
- Clutter that prevents access to standard cleaning areas
- Pet-related messes, excessive pet hair, or odor conditions
- Post-construction dust/debris, paint overspray, or drywall residue
- Hoarding conditions, biohazards, pests/infestation, or unsafe environments
- Larger-than-booked spaces or significantly expanded scope
When feasible, we will notify you before applying additional charges. If conditions prevent safe or reasonable completion, we may stop service and charge for time spent and/or a trip/lockout fee.
4.7 Payments, Authorization & Billing Disputes
Payment is due at the time of service unless otherwise agreed upon in writing for commercial clients. By booking, you authorize Tampa Bay Shine (and our payment processor) to charge the payment method on file for the booked service total, and for any approved add-ons, upgrades, surcharges, or fees described in these Terms.
If you believe there is a billing error or service issue, please contact us directly first so we can resolve it promptly (see Section 6).
5. Cancellation, Rescheduling & Access
5.1 Cancellations
To avoid cancellation fees, cancellations must be made at least 48 hours before the scheduled appointment. Short-notice cancellations, late cancellations, or lockouts may incur a fee equal to up to 50% of the scheduled service cost.
5.2 Access to Property
You are responsible for providing safe access to the property (entry instructions, gate codes, parking access, and any necessary approvals). If cleaners cannot access your property at the scheduled time, a lockout fee may be applied.
5.3 Utilities, Water, Power & Safe Working Conditions
- Running water and electricity must be available for the duration of the service unless otherwise agreed in writing.
- We may pause, stop, or reschedule service if conditions are unsafe (e.g., aggressive animals, hazards, strong odors, pests/infestation, broken glass, exposed wiring, weapons left unsecured, or other safety issues).
- If you request that we use client-supplied equipment/products, you accept responsibility for their condition and suitability (and any reactions/damage arising from them).
5.4 Safety Limits (Lifting, Heights, Moving Items)
- For safety, our team is not required to lift heavy objects, move large furniture/appliances, or clean at heights beyond a standard step stool unless specifically agreed in writing.
- We are not responsible for incomplete cleaning results due to blocked access, clutter, or items that cannot be safely moved.
6. Satisfaction Guarantee & Limitations
Tampa Bay Shine offers a 24-hour satisfaction guarantee. If an area was missed or not cleaned to expectations within the booked scope, we will return to re-clean the specific area at no additional cost when reported within the window below.
Limitations of the guarantee:
- Only applies to areas included in the original service checklist / booked scope
- Does not apply to conditions outside our control (stains, severe buildup, permanent residue, etching, discoloration, rust, hard-water damage, grout failure, or normal wear and tear)
- Must be reported within 24 hours of service completion
- Does not apply if third parties entered the property after our visit or if the area was altered after service
6.1 How to Report Issues (Direct Resolution First)
Any service concerns must be addressed with Tampa Bay Shine directly. Please contact us within 24 hours with a brief description and, when possible, supporting photos/videos so we can evaluate and make it right.
6.2 Remedy: Re-Clean or Credit
At our discretion and depending on the circumstances, we may offer (a) a re-clean of the affected area(s), or (b) a credit to be applied toward your next cleaning. Credits are non-cash, non-transferable, and expire if not used within a reasonable period stated at issuance.
6.3 Billing Disputes & Chargebacks
If you believe there is a billing error or service issue, you agree to contact Tampa Bay Shine first and provide a reasonable opportunity to resolve the matter before initiating a payment dispute, chargeback, or reversal with your bank or card issuer.
Initiating a chargeback without first contacting us may delay resolution and may result in suspension of future services until the dispute is resolved. Nothing in this section limits any rights you may have under applicable law.
7. Liability & Damages
While our team takes great care when cleaning your property, accidents can happen. Tampa Bay Shine carries general liability insurance. The following terms allocate risk and set expectations for claims.
7.1 Client Responsibilities (Valuables, Fragile Items, Instructions)
- Clients agree to secure or remove fragile, sentimental, or irreplaceable items (including cash, jewelry, collectibles, artwork, firearms, and documents) prior to service.
- We are not responsible for items that are not reasonably visible, are improperly stored, or are located in cluttered areas where access is restricted.
- You agree to disclose any known fragile/loose fixtures, special surface care requirements, and areas/items that should not be touched.
7.2 What We Are Not Responsible For
To the fullest extent permitted by law, Tampa Bay Shine is not responsible for:
- Pre-existing damage, prior wear, water damage, rot, rust, mold, or deterioration
- Normal wear and tear, loose/grouted tile issues, failing caulk, or unstable fixtures/shelving/furniture
- Damage resulting from improperly installed, previously damaged, or unsafe items/surfaces
- Stains or discoloration that cannot be removed with standard cleaning methods
- Damage caused by third parties, or by client-supplied products/equipment requested for use
- Loss of or damage to items not disclosed as fragile/high-value or left in cluttered areas
7.3 Damage Reporting & Inspection Window
Any claim of damage allegedly caused by our team must be reported to Tampa Bay Shine within 24 hours of service completion. You must provide reasonable documentation (photos/videos) and allow Tampa Bay Shine an opportunity to inspect the alleged damage before repairs or replacements are made, unless immediate action is required for safety.
7.4 Limitation of Liability
To the fullest extent permitted by law, Tampa Bay Shine’s total liability for any claim arising out of or relating to the services (whether in contract, tort, negligence, strict liability, or otherwise) shall not exceed the amount actually paid for the specific service visit giving rise to the claim.
In no event will Tampa Bay Shine be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.
7.5 Hazardous Conditions / Right to Stop Service
If we encounter unsafe or hazardous conditions (including but not limited to bodily fluids, sharps, pest infestation, strong chemical fumes, unsecured weapons, aggressive animals, excessive mold, or structural hazards), we may stop service immediately. Fees may still apply for time spent and travel.
7.6 Pets, Alarms & Security Systems
- Pets must be secured in a safe manner during service. Tampa Bay Shine is not responsible for pets escaping due to unsecured doors/gates or client instructions.
- Clients are responsible for disarming alarms or providing correct codes. False alarm fees or lockout costs caused by incorrect instructions may be charged to the client.
7.7 Indemnification
You agree to indemnify and hold harmless Tampa Bay Shine from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from (a) your breach of these Terms, (b) unsafe conditions at the property, (c) misrepresentation of home size/scope, or (d) instructions to use client-supplied products/equipment.
7.8 Force Majeure
Tampa Bay Shine is not liable for delays, missed appointments, or inability to perform services due to events outside our reasonable control, including weather events, natural disasters, power outages, road closures, acts of government, or emergencies.
7.9 Quality Control Photos
We may take before/after photos for internal quality control and training. We do not intentionally photograph personal identifying information. Any marketing use requires separate customer permission.
8. Commercial Client Terms
8.1 Scope, Work Orders & Change Requests
Commercial services may be performed based on a statement of work, proposal, work order, or recurring schedule. Any change to the scope (additional rooms, tasks, frequencies, or special projects) may require a written change request and may result in updated pricing.
8.2 Access, Security & Site Rules
- Commercial clients must provide appropriate access (badges, keys, codes, elevators, loading procedures) and disclose any building rules that impact service.
- If access is denied or delayed, we may reschedule and/or charge a lockout/trip fee or bill for waiting time where permitted.
- Clients are responsible for securing confidential materials, cash, and sensitive documents. Tampa Bay Shine is not responsible for loss of items that should be secured under normal business practices.
8.3 Supplies & Consumables
Unless otherwise agreed in writing, Tampa Bay Shine supplies standard cleaning tools and products needed to perform cleaning services. Consumables such as paper towels, toilet paper, liners, and hand soap are typically the client’s responsibility unless specified in a written agreement.
8.4 Sensitive Environments (Medical, Financial, Legal, etc.)
If your facility contains regulated or sensitive areas (e.g., patient areas, medication rooms, server rooms, secured records), you must clearly identify restricted zones and provide written instructions. We are not responsible for compliance requirements outside the scope of our agreed cleaning services.
8.5 Invoicing, Payment Terms, Late Fees & Suspension
If invoicing terms are extended for commercial clients, payments are due according to the invoice terms. Past-due balances may incur late fees where permitted by law, and services may be suspended until the account is current. Clients agree to pay reasonable costs of collection (including attorneys’ fees) to the extent permitted by law.
8.6 After-Hours, Parking, and Site Constraints
If parking fees, tolls, paid access, or after-hours requirements apply, the client may be responsible for those costs unless otherwise agreed in writing.
9. Workforce, Site Conduct & Non-Solicitation
9.1 Relationship
Tampa Bay Shine may perform services using employees and/or independent contractors under our direction. Nothing in these Terms creates an employment relationship between the client and Tampa Bay Shine personnel.
9.2 Respectful Conduct
Harassment, discrimination, unsafe conduct, or abusive behavior toward our team is grounds for immediate termination of service, with applicable fees for time spent and travel.
9.3 Non-Solicitation
To protect our workforce and training investment, you agree not to directly solicit for hire or engage Tampa Bay Shine personnel for cleaning services outside of Tampa Bay Shine for a period of 12 months following the last service date, except where prohibited by law. If a direct-hire occurs, you agree to pay a reasonable placement fee to Tampa Bay Shine upon request.
This section is intended as a business protection; it does not limit any rights you may have under applicable law.
10. Third-Party Links & Integrations
Our website may include links to third-party sites such as scheduling platforms, payment processors, or social media platforms. Tampa Bay Shine is not responsible for the content, security, or practices of external websites.
Use of third-party sites is at your own risk.
11. Website Accuracy & Updates
Information on this website may contain typographical or technical errors. Tampa Bay Shine may update services, pricing, descriptions, or policies at any time without notice. We do not guarantee that any website content is current, accurate, or complete.
12. Modifications to Terms
Tampa Bay Shine may revise these Terms & Conditions at any time. By continuing to use the website after updates are posted, you agree to the revised terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Failure to enforce any provision is not a waiver of our right to enforce it later.
13. Governing Law
These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any legal claims or disputes must be filed in a court of competent jurisdiction in Hillsborough County, Florida (or another nearby Florida county with proper jurisdiction/venue).
Before filing any legal action, you agree to make a good-faith effort to resolve disputes informally by contacting Tampa Bay Shine directly.
